就算contract没签。。还是可以要求赔偿。。因为你已经订下了

不如换个角度看看。。如果说你朋友要了房子。。房东突然说不租了。。你们会不会要赔偿呢?
在这里信用很重要。。不是说你们要不要就行的。。

如果说你签了合同。。哪怕是1秒赔偿也是要的。。

我还是那一句。。换一个角度看。。如果你签了合同。。deposit付了。。房东1分钟后反悔。。你就会这样接受吗?

还有如果contract签了。。房东有绝对的权力追讨一切损失。。这还包括房租。。前提是。。房东必须mitigate losses.

1. Agreement forms part of Contract.
2. Contract need not to be signed as long as there is offer and acceptance. Hence, verbal contract is enforceable. The act of paying bond/ deposit constitutes acceptance of offer. Offer is in place when the leasor offered the room for rent to the leasee.
3. Deposit will probably only be refundable if there is an exclusion clause specifically mentioned in the contract or verbally agreed, or as allowed by laws and regulation etc, eg. TPA or RTA.

A rental bond is money that the tenant pays at the beginning of a tenancy which the lessor/agent can claim if the tenant owes money for rent, damages, or other costs at the end of the tenancy. The rental bond is not the same as paying rent in advance.

Bond是不是一定要全部要退还呢?
答案是不一定。。要看你是否把房子该修的修。。该洗的洗。。该付的付。

Summary of facts from the case
1. Contract是有签的。
2. Bond = $200
3. Contract 签多久是一个疑问
4. Contract 从何时开始也是一个疑问。

假设1

Contract签了半年(这个是一个比较平常的Contract length).
A一个星期后搬进去(假设A今天签Contract,她会在31号搬进去).

A签了马上要毁约。。正常会发生的如下。
If a prospective tenant completes an application for tenancy and is accepted as a tenant and then decides against entering into a tenancy agreement they may find that the lessor/agent still wants to charge rent or claim compensation until a replacement tenant can be found.

如果A要把$200都要回来。。他要做的是在31一号以前找一个Approved tenant 搬进去。。那个approved tenant 必须同意延续A签的Contract.

如果说A不能找人搬进来。。那房东有权利要求A继续付房租。。如果A不付。。房东可以从Bond里面扣。。Bond扣完了呢?房东可以去Small Claim Tribunal 起诉A继续要求赔偿。。一直到有人搬进去为止。

终结

不管是Bond是deposit是rent in advance,如果A毁约那房东要求赔偿是合理的。。

我想你理解有一点错误。。

这里完全没有提到Contract 签了。。所以你在于Contract签不签的观点是不成立的。。

在这里要理解的是"Completes an application". 到底什么事情可以成立"Completes an application"要看case law.
